There are two types of LPA, one concerns decisions about your Health & Welfare such as consenting to medical treatments or selecting a care package, and the other governs your Property & Financial Affairs such as selling property or paying bills.
You can select the same or different attorneys for each LPA and include guidance, preference or instructions to ensure any decisions they make on your behalf reflect your wishes and values accurately. Further information can be found in our guidance note Lasting Powers of Attorney.
An Advance Decision (sometimes known as an Advance Directive or a Living Will) allows you to explain to your family, carers and health professionals your decisions about refusing specific medical treatments in certain circumstances, should you become incapable of making those decisions personally. They can be prepared in conjunction with a Health & Welfare LPA.
Our fixed fees for completing straightforward LPAs for individuals or couples preparing those in “mirror” terms are set out below and include the cost of submitting the completed LPA documents to the Office of the Public Guardian (OPG) for registration. However, there will be an additional fee payable to the OPG of £82 per LPA document, which is not included in our fixed fee.
It is unusual for an LPA to be charged at a higher fee than the fixed fees set out below, but there may be circumstances where very detailed guidance or instructions are to be included and a higher fee is warranted for the additional drafting required. If so, that will be discussed with you at the initial appointment and agreed before any chargeable work is undertaken.
